1. Scope of application 
1.1 The business transaction and delivery take place exclusively to the following general trading conditions (AGB).
1.2 Any provisions of the customer that conflict with or deviate from the following General Terms and Conditions shall not apply.
1.3 If working days are specified as deadlines, this shall mean all weekdays with the exception of Saturdays, Sundays and German public holidays.

2. Inspection Of The Text Of The Contract And The General Terms And Conditions Of Business
2.1 We save the text of the contract and send you the order data by e-mail. Orders can be viewed in your customer account, if you have created one. If you have not created a customer account, the contract data is no longer accessible on the Internet for security reasons.
2.2 You can view, print and save these terms and conditions at any time at https://www.niluhswati.com.

3. Conclusion Of Contract / Delivery Reservation 
3.1 The presentation of the products in the webshop www.niluhswati.com is not a legally binding offer, but a non-binding online catalog. By clicking the button "Buy now!" at the end of the order process you place a binding order for the goods in the shopping cart. After this order placement, NI LUH PUTU SUSILAWATI (NILUH SWATI) sends an e-mail confirmation about the receipt of the order. This e-mail is only a confirmation of receipt and not an acceptance of the order. A contract between NI LUH PUTU SUSILAWATI (NILUH SWATI) and you will only be formed when NI LUH PUTU SUSILAWATI (NILUH SWATI) confirms to you by e-mail that the ordered goods have been dispatched. Only the goods listed in the e-mail sent at the time of dispatch are part of the contract. 
3.2 Artwork Description:
All artworks offered for sale are original creations by Niluh Swati and are sold as presented on the website, unless explicitly stated otherwise.
3.3 Commissioned Artwork:
Custom-made commissioned artworks are excluded from the statutory right of withdrawal and are non-refundable once completed and delivered to the customer. These works are created specifically according to the buyer’s instructions and are therefore not eligible for return or refund, pursuant to § 312g para. 2 no. 1 of the German Civil Code (BGB).

4. Payment / Prices 
4.1 The available payment methods are shown on the separate page "FAQ". Payment by sending cash or checks is unfortunately not possible.
4.2 If you have to make a chargeback or any other reversal of payment without justification, you will have to bear the costs incurred.
4.3 All prices contained in the webshop niluhswati.com are Euro amounts. According to §19 of the German VAT Act (Kleinunternehmerregelung), no VAT is charged.

5. Shipping 
The shipping costs information are on the separate page "FAQ". Orders are processed and shipped via trusted carriers such as DHL, UPS, or FedEx. Once your artwork has been dispatched, you will receive a tracking number to monitor the delivery. The choice of carrier depends on the destination, service availability, and logistical considerations.

6. Damage In Transit
If a package is lost, Niluh Swati will work with the shipping carrier’s insurance to resolve the issue. Compensation will be handled according to the carrier’s policy. All shipments (excluding open prints) are fully insured. If your artwork arrives damaged, please contact Niluh Swati within 48 hours of delivery with photos of the damage. 7. Foreign Deliveries / Customs Duties 
Customs duties do not apply to shipments within the European Union (EU). Exceptions to this are those areas that do not belong to the customs territory of the EU; therefore, please inform yourself about the applicable customs regulations in your area before making your purchase. Outside the EU, there are generally fees for importing goods from the EU.
Fees may be charged by the respective country of destination according to the customs requirements applicable there on goods sold from the EU to a country outside the EU or to a country with special regulations within the EU. 
Customs fees are to be borne by the customer and the customer must carry out the relevant administrative matters himself, e.g., collection of the ordered goods from customs and completion of the formalities.
More detailed information on the individual customs regulations and the respective amount of customs fees must be obtained by the customer in advance from the relevant customs office. 

8. Warranty / Notice Of Defects 
8.1 There are the statutory warranty rights for goods.
8.2 Please inform NI LUH PUTU SUSILAWATI (NILUH SWATI) about obvious defects of the goods immediately. If your artwork arrives damaged, please contact Niluh Swati within 48 hours of delivery with photos of the damage. Niluh Swati will assist with the shipping carrier’s insurance claim.
8.3 NI LUH PUTU SUSILAWATI (NILUH SWATI) strives for customer satisfaction and will check your request as soon as possible and contact you as soon as possible. If you have contacted NI LUH PUTU SUSILAWATI (NILUH SWATI) via email and have not received a response after 5 business days, please let us know your concern again or via WhatsApp +49 17630581949. In rare cases, an email may have been "stuck" in the spam filter (by us or by you), or an email may not have reached NI LUH PUTU SUSILAWATI (NILUH SWATI) by some other means. Your rights as a consumer in case of a defect are not limited by this.
8.4 Post-Delivery Damage: Once the artwork has been delivered and signed for, the customer assumes full responsibility for the care and proper handling of the artwork. This includes safe storage, display, and cleaning. Damage to the artwork occurring after delivery—such as through improper handling, hanging, or storage, is not eligible for return refund.

9. Right Of Revocation 
Consumers have a right of withdrawal in the EU according to the applicable regulations, which you can find separately under revocation (refund policy).

10. Liability
10.1 We shall be liable without limitation for damages resulting from injury to life, limb or health, guarantees for the quality of the object of purchase, fraudulent concealment of defects, and claims under the Product Liability Act.
10.2 Notwithstanding Section 9, our liability for slightly negligent breaches of duty shall be excluded unless material contractual obligations (the fulfillment of which is essential to the proper performance of the contract and/or the breach of which jeopardizes the achievement of the purpose of the contract and the fulfillment of which the customer may regularly rely on (so-called cardinal obligations)) are affected. This shall also apply to corresponding breaches of duty by our vicarious agents.
10.3 Our liability for slightly negligent breaches of cardinal obligations shall be limited to the damage typical for the contract and foreseeable at the time of conclusion of the contract.

11. Rights Of Use 
11.1 The page of the webshop https://www.niluhswati.com, as well as the sub-pages and logos listed therein, enjoy copyright protection. The pictures contained in it are in all probability protected according to § 2 Abs. 5 UrhG Copyright Act) as photographic works, respectively works which are produced similar to photographic works, but at least according to § 72 UrhG as photographic works, respectively products which are produced similar to photographic works. NI LUH PUTU SUSILAWATI (NILUH SWATI) holds the exclusive rights of use.
11.2 Publications, duplications, and distributions which are based on the protected intangible property are only allowed with the written permission of NI LUH PUTU SUSILAWATI (NILUH SWATI).

12. Final Provisions 
12.1 For all disputes arising from or in connection with legal transactions or other legal relationships with NI LUH PUTU SUSILAWATI (NILUH SWATI), the exclusive place of jurisdiction is Frankfurt am Main, Germany. The applicable law is that of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and other intergovernmental agreements shall not apply, even if adopted into German law.
12.2 In the case of contracts for a purpose which cannot be attributed to the professional or commercial activity of the entitled person (consumer contracts), the choice of law under section 12.1 shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence. 
12.3 The contractual language shall be in English.
12.4 You shall only have a right of set-off if your counterclaims have been legally established or are undisputed or acknowledged by us. Furthermore, you shall only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.
12.5 If the customer is in default with any payment obligations towards us, all existing claims shall become due immediately. 

13. Information On Online Dispute Resolution 
The EU Commission provides an internet platform for the online settlement of disputes (so-called "OS platform"). The ODR platform is intended to serve as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts.

14. Severability Clause 
Should individual provisions of the contract, including these regulations, be or become invalid in whole or in part, or should the contract contain an unforeseen loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective statutory provisions.

1. Geltungsbereich
1.1 Die Geschäftsabwicklung und Lieferung erfolgen ausschließlich auf Grundlage der nachfolgenden Allgemeinen Geschäftsbedingungen (AGB).
1.2 Abweichende oder entgegenstehende Bedingungen des Kunden finden keine Anwendung.
1.3 Soweit Werktage als Fristen angegeben sind, gelten alle Wochentage mit Ausnahme von Samstagen, Sonntagen und gesetzliche Feiertage in Deutschland.

2. Einsicht In Den Vertragstext Und Die Allgemeinen Geschäftsbedingungen
2.1 Der Vertragstext wird von uns gespeichert und die Bestelldaten per E-Mail an Sie versendet. Ihre Bestellungen sind in Ihrem Kundenkonto einsehbar, sofern Sie ein solches erstellt haben. Haben Sie kein Kundenkonto erstellt, ist der Vertragstext aus Sicherheitsgründen nicht mehr über das Internet zugänglich.
2.2 Diese Allgemeinen Geschäftsbedingungen können jederzeit unter https://www.niluhswati.com eingesehen, ausgedruckt und gespeichert werden.

3. Vertragsschluss / Vorbehalt Der Lieferung
3.1 Die Darstellung der Produkte im Webshop auf niluhswati.com stellt kein rechtlich bindendes Angebot, sondern einen unverbindlichen Online-Katalog dar. Mit dem Klick auf den Button „Jetzt kaufen!“ am Ende des Bestellprozesses geben Sie ein verbindliches Angebot zum Kauf der im Warenkorb befindlichen Waren ab.
Nach Abgabe der Bestellung erhalten Sie eine E-Mail zur Bestätigung des Eingangs der Bestellung durch NI LUH PUTU SUSILAWATI (NILUH SWATI). Diese E-Mail stellt lediglich eine Empfangsbestätigung dar und noch keine Annahme des Vertragsangebotes.
Ein Kaufvertrag kommt erst mit dem Versand einer Versandbestätigung per E-Mail durch NI LUH PUTU SUSILAWATI (NILUH SWATI) zustande. Vertragsgegenstand sind ausschließlich die in dieser E-Mail aufgeführten Produkte.
3.2 Beschreibung der Kunstwerke:
Alle zum Verkauf angebotenen Kunstwerke sind Originalwerke von Niluh Swati und werden – sofern nicht ausdrücklich anders angegeben – in dem auf der Website dargestellten Zustand verkauft.
3.3 Auftragsarbeiten (Kommissionsarbeiten):
Individuell angefertigte Auftragsarbeiten sind vom Widerrufsrecht ausgeschlossen und nach Fertigstellung sowie Lieferung an den Kunden nicht erstattungsfähig. Diese Werke werden speziell nach Kundenvorgaben gefertigt und sind gemäß § 312g Abs. 2 Nr. 1 BGB vom gesetzlichen Widerrufsrecht ausgenommen.

4. Zahlung / Preise
4.1 Die verfügbaren Zahlungsmethoden sind auf der separaten Seite „FAQ“ dargestellt. Eine Zahlung durch Zusendung von Bargeld oder Schecks ist leider nicht möglich.
4.2 Bei unberechtigten Rückbuchungen oder sonstigen unrechtmäßigen Zahlungsrücknahmen sind die dadurch entstehenden Kosten von Ihnen zu tragen.
4.3 Alle im Webshop niluhswati.com angegebenen Preise verstehen sich in Euro. Gemäß § 19 UStG (Kleinunternehmerregelung) wird keine Umsatzsteuer ausgewiesen.

5. Versand
Informationen zu den Versandkosten finden Sie auf der separaten Seite „FAQ“. Bestellungen werden über zuverlässige Versanddienstleister wie DHL, UPS oder FedEx abgewickelt und versendet. Sobald Ihr Kunstwerk versendet wurde, erhalten Sie eine Sendungsverfolgungsnummer, mit der Sie den Versandstatus nachverfolgen können. Die Wahl des Versanddienstleisters erfolgt abhängig vom Zielland, der Verfügbarkeit des Dienstes und logistischen Erfordernissen.

6. Transportschäden
Geht ein Paket verloren, erfolgt eine Klärung in Zusammenarbeit mit der Transportversicherung des Versanddienstleisters. Die Entschädigung erfolgt gemäß dessen Bedingungen. Alle Sendungen (außer offene Drucke) sind vollständig versichert.
Sollte Ihr Kunstwerk beschädigt ankommen, setzen Sie sich bitte innerhalb von 48 Stunden nach Zustellung per E-Mail (mit Fotos des Schadens) mit Niluh Swati in Verbindung: niluhswati.art@gmail.com oder WhatsApp +49 17630581949. Niluh Swati unterstütz Sie bei der Schadensmeldung an den Versanddienstleister.

7. Auslandslieferungen / Zoll
Für Lieferungen innerhalb der Europäischen Union (EU) fallen keine Zollgebühren an. Ausgenommen hiervon sind Gebiete, die nicht zum Zollgebiet der EU gehören. Bitte informieren Sie sich vor dem Kauf über die für Ihren Wohnsitz geltenden Zollbestimmungen.
Außerhalb der EU fallen in der Regel Einfuhrgebühren an.
Die jeweilige Zollabwicklung (z. B. Abholung der Ware beim Zoll, Ausfüllen von Formularen) liegt in der Verantwortung des Käufers. Zollgebühren sind vom Kunden zu tragen.
Detaillierte Informationen zu den geltenden Vorschriften und Gebühren müssen vom Kunden eigenständig bei der zuständigen Zollbehörde eingeholt werden.

8. Gewährleistung / Mängelanzeige
8.1 Es gelten die gesetzlichen Gewährleistungsrechte für Waren.
8.2 Bitte melden Sie offensichtliche Mängel der gelieferten Ware umgehend. Bei Beschädigung der Ware setzen Sie sich bitte innerhalb von 48 Stunden mit Niluh Swati in Verbindung und senden Sie Fotos des Schadens an: niluhswati.art@gmail.com. Niluh Swati unterstütz Sie bei der Schadensregulierung mit dem Versanddienstleister.
8.3 NI LUH PUTU SUSILAWATI (NILUH SWATI) ist um Kundenzufriedenheit bemüht und wird Ihre Anfrage schnellstmöglich prüfen und beantworten. Sollte innerhalb von 5 Werktagen keine Rückmeldung erfolgen, kontaktieren Sie uns bitte erneut oder via WhatsApp +49 17630581949. In Einzelfällen können E-Mails im Spamfilter landen oder auf anderem Wege nicht ankommen. Ihre gesetzlichen Rechte bleiben hiervon unberührt. 
8.4 Schäden nach der Lieferung: Nach erfolgter Zustellung und Empfangsbestätigung durch den Kunden bzw. die Kundin liegt die Verantwortung für die sachgemäße Handhabung und Pflege des Kunstwerks bei der empfangenden Person. Dies betrifft insbesondere Lagerung, Aufhängung und Reinigung. Ausschluss: Schäden, die nach der Lieferung durch unsachgemäße Handhabung, Lagerung oder Präsentation entstehen, sind von Rückgabe, Erstattung oder Gutschrift ausgeschlossen.

9. Widerrufsrecht
Verbraucher innerhalb der EU haben ein Widerrufsrecht gemäß den jeweils geltenden gesetzlichen Bestimmungen, dass Sie gesondert unter „Widerrufsbelehrung“ finden.

10. Haftung
10.1 Wir haften uneingeschränkt für Schäden aus der Verletzung von Leben, Körper oder Gesundheit, bei Übernahme von Garantien für die Beschaffenheit der Kaufsache, bei arglistigem Verschweigen von Mängeln sowie bei Ansprüchen aus dem Produkthaftungsgesetz.
10.2 Unbeschadet Ziffer 9 ist unsere Haftung für leicht fahrlässige Pflichtverletzungen ausgeschlossen, sofern keine wesentlichen Vertragspflichten (sog. Kardinalpflichten) verletzt werden. Dies gilt auch für entsprechende Pflichtverletzungen unserer Erfüllungsgehilfen.
10.3 Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt.

11. Nutzungsrechte
11.1 Die Seiten des Webshops https://www.niluhswati.com sowie die darin enthaltenen Unterseiten und Logos unterliegen dem Urheberrecht. Die enthaltenen Bilder sind nach § 2 Abs. 5 UrhG als Lichtbildwerke oder nach § 72 UrhG als Lichtbilder urheberrechtlich geschützt. NI LUH PUTU SUSILAWATI (NILUH SWATI) besitzt die ausschließlichen Nutzungsrechte.
11.2 Veröffentlichungen, Vervielfältigungen und Verbreitungen der geschützten Inhalte sind nur mit schriftlicher Genehmigung von NI LUH PUTU SUSILAWATI (NILUH SWATI) erlaubt.

12. Schlussbestimmungen
12.1 Für alle Streitigkeiten aus oder im Zusammenhang mit rechtlichen Geschäften oder sonstigen Rechtsbeziehungen mit NI LUH PUTU SUSILAWATI (NILUH SWATI) ist der ausschließliche Gerichtsstand Frankfurt am Main, Deutschland. Es gilt das Recht der Bundesrepublik Deutschland. Das Übereinkommen der Vereinten Nationen über Verträge über den internationalen Warenkauf (CISG) sowie sonstige zwischenstaatliche Übereinkommen finden keine Anwendung, auch wenn sie in das deutsche Recht übernommen wurden.
12.2 Bei Verträgen mit Verbrauchern im Sinne des § 13 BGB gilt diese Rechtswahl nur, soweit dadurch nicht zwingende Verbraucherschutzvorschriften des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, entzogen werden.
12.3 Vertragssprache ist Englisch.
12.4 Ein Recht zur Aufrechnung steht Ihnen nur zu, wenn Ihre Gegenansprüche rechtskräftig festgestellt, unbestritten oder von uns anerkannt sind. Ein Zurückbehaltungsrecht besteht nur, wenn und soweit Ihr Gegenanspruch auf demselben Vertragsverhältnis beruht.
12.5 Gerät der Kunde mit einer Zahlungsverpflichtung in Verzug, werden sämtliche bestehende Forderungen sofort fällig.

13. Information Zur Online-Streitbeilegung
Die EU-Kommission stellt eine Plattform zur Online-Streitbeilegung (sog. „OS-Plattform“) bereit. Diese dient als Anlaufstelle zur außergerichtlichen Beilegung von Streitigkeiten, die sich aus Online-Kaufverträgen ergeben.

14. Salvatorische Klausel
Sollten einzelne Bestimmungen dieses Vertrages einschließlich dieser Regelungen ganz oder teilweise unwirksam sein oder werden oder sollte der Vertrag eine Regelungslücke enthalten, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Anstelle der unwirksamen oder fehlenden Bestimmungen treten die gesetzlichen Vorschriften in Kraft.
